At BRAVEPORT, we are committed to protecting the privacy of our customers and visitors to our website. We understand and support public concerns regarding the use and protection of nonpublic personal information and are committed to restricting the use and disclosure of such information as required by applicable law to the extent that it comes into the possession of the company. BRAVEPORT recognizes and complies with its obligations to maintain confidentiality of all personal, financial, health and medical information received from or pertaining to policy owners and insured individuals in connection with the products and services offered by BRAVEPORT. Our Privacy Policy & Terms of Use (“Privacy Policy”) details why we gather personal information, the type of information we collect, how we collect it, what we may use the information for, to whom we allow access, how we protect it and how you can instruct us if you prefer to limit the use of that information.
II. Your Rights Regarding Personal Information
- You have the right to know why a company collects, uses and discloses your personal information.
- You have the right to expect a company to handle your personal information reasonably and to not use it for any purpose other than the one to which you consented.
- You have the right to expect a company to protect your personal information from unauthorized disclosure.
- You have the right to inspect the personal information company holds about you and make sure it is accurate, complete and current.
- You have the right to expect a company to destroy your personal information when requested by you or when no longer required for the intended purpose.
III. Collection, Use and Disclosure of Personal Information
BRAVEPORT collects personal information in order to process applications for viatical/life settlements, applications for life insurance loans, applications to obtain insurance coverage, applications to secure premium financing or other financial products, and personal information necessary to allow BRAVEPORT to provide administrative support relating to the variety of products and services offered by BRAVEPORT (the “Business Purpose”). In consideration of proposals or offers for sale of life insurance policies, certain types of nonpublic personal information must be obtained by BRAVEPORT. This personal information may be provided to BRAVEPORT by you in a variety of ways, including but not limited to: information provided by you during telephone interviews; information provided to BRAVEPORT on forms completed by you; information provided to BRAVEPORT on our Web site; or information collected by a your insurance agent, financial professional, accountant, attorney or other representative (collectively “Representatives”) which is then forwarded to BRAVEPORT.
BRAVEPORT will only collect your personal information that is necessary to facilitate the Business Purpose. We may use this information in order to:
- Assess your application to determine whether you qualify for the products and services offered by BRAVEPORT;
- Obtain life expectancy evaluations from one or more life expectancy companies;
- Communicate with you and your Representatives in a timely and efficient manner;
- Obtain medical information from your physician and other medical provider(s);
- Analyze demographic and other business results;
- Detect and prevent fraudulent activities; or
- Act as required or authorized by federal, state or other laws.
In furtherance of performing the Business Purpose, BRAVEPORT will collect personal information from our customers and their Representatives, including but not limited to the following types of information: name, address, telephone number(s), email addresses, social security number(s), date of birth, insurance coverage details and history, insurance policy information, health and medical information, marital information, beneficiary information, financial information, and information pertaining to lawsuits, bankruptcies, judgments and creditor liens. In the event we request health and/or medical information or communication with your medical provider(s), we will only do so following your execution of an Authorization for Disclosure of Protected Health Information (“PHI”) release in compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
BRAVEPORT will only disclose your personal information to third parties when necessary to facilitate the Business Purpose, or where we are otherwise entitled or required to do so by law. Third parties we may disclose personal information to include: your Representatives, life expectancy companies, insurance carrier(s), medical provider(s), viatical/life settlement provider companies, financing entities and investors, life insurance lenders, viatical/life settlement brokers, auditors, regulatory bodies, our internal and external accountants, outside legal counsel, and external contractors who provide data backup and restoration. We may disclose your information to third parties when required by law or in the good-faith belief that such action is necessary to:
- Protect and defend the rights and/or property of BRAVEPORT;
- Identify persons who may be violating the law or the rights of third parties; or
- Cooperate with the investigation of any purported unlawful activities.
BRAVEPORT will not sell your personal information to any individuals or outside organizations. We will not share your information with organizations outside of our relationship with you for the purpose of contacting you about their own products or services. We may however use your personal information to market other products and services offered by us. We have implemented the necessary procedures to ensure that an individual is not sent marketing material if they do not wish their personal information used for this purpose.
Normally you can gain full access to the personal information that we hold about you, except in some cases where there may be some legal or administrative reason to deny access, in which case we will provide you with the reason for denial. We aim to ensure that the personal information retained is accurate, complete and current. To assist us with this, we will give you the opportunity to advise us if any of your information has changed. If you have any concerns about the completeness or accuracy of the information held by us, we will take the necessary steps to correct it.
BRAVEPORT reserves the right to transfer information in connection with the sale of all or part of BRAVEPORT and its assets. Furthermore, we are not responsible for any breach of security or for any actions of any third parties which receive the personal information.
IV. Protection of Personal Information
We use security procedures to protect the personal information we hold. Access to and the use of personal information is appropriately limited to prevent misuse or unlawful disclosure of the information. BRAVEPORT protects the security of the information submitted to us. The importance of security for all personal information is of the utmost importance to us. Our secure servers protect your information using advanced technology. We maintain physical, electronic and procedural safeguards that comply with all applicable regulatory standards to guard your nonpublic personal information. BRAVEPORT uses reasonable precautions to keep the information disclosed to us secure.
We will maintain a physical and/or electronic record of your personal information at the offices of BRAVEPORT to comply with federal and state regulations. All employees of BRAVEPORT are required to sign and acknowledge a Confidentiality and Nondisclosure Agreement and are trained on the importance of protecting and keeping your personal information confidential. We limit employee access to nonpublic personal information only to those who need to know this information in order to serve customer relationships. Our employees are educated about the importance of privacy and instructed to use the information only for the purposes intended. We have established physical and systems safeguards, along with proper processes, to protect your personal information from unauthorized access or use.
V. Online and Electronic Information Privacy Policy
For each visitor to our website, our web server automatically recognizes only the visitor’s domain name and IP address, but not the e-mail address (where possible). The domain name and IP address reveal nothing personal about you other than the IP address and the domain name from which you have accessed our website. We may also track certain information about the use of our website, such as the source address of a page request and the date and time of the page request. We use this data to better understand use of our website and user preferences. This information is stored in log files and is used for aggregated and statistical reporting. We do not share, rent or sell our subscriber lists to any other organization for any reason. If you wish to review, edit, or want us to permanently delete your information, please contact us.
BRAVEPORT uses “popups” solely for the purpose of its top level navigation bars in order to invoke drop down menu selection to sub pages. In addition, we will occasionally use a “cookie”. A cookie is a small file that a website stores on your computer. We use cookies for a number of administrative purposes; for example, to gather data about the usage of our website, to store your preferences for certain kinds of information, or to store a password so that you do not have to input it every time you visit our site. Our use of cookies does not require that they contain personally identifiable information about you. It simply allows the web server to recognize you during your next visit to our site. You can decide if and how your computer will accept a cookie by configuring your preferences or options in your browser. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it. If you submit a request for instant estimate or a form through our website, we may keep the information you send in an electronic database. We use security measures to protect against the loss, misuse, and the alteration of data used in our systems. If you are applying for a quote, we may need to know your name, e-mail address, mailing address and other personal, health related and financial information. This allows us to evaluate your current situation and present you with the product or service. BRAVEPORT is the owner of the information which is collected on our website. We will not sell, disseminate, disclose, trade, transmit, transfer, share, lease or rent any personally identifiable information to any third party not authorized by you to receive your information except as we have disclosed to you in this Privacy Policy.
We may also request your e-mail address or mailing address for the purposes of conducting a survey or to provide additional services (for example, subscriptions to e-mail newsletters, announcement lists or information about seminars). Whenever we request the identity of a visitor, we will clearly indicate the purpose of the inquiry before the information is requested. Unless explicitly stated, e-mail is not secure. We recommend that you do not send any confidential information through e-mail. If you send e-mail to us, we may retain the contents of your e-mail message, your e-mail address, and our response.
BRAVEPORT’s website may contain links to third party website that are not controlled by BRAVEPORT. These third party links are made available to you as a convenience and you agree to use these links at your own risk. Please be aware that BRAVEPORT is not responsible for the content of third party website nor are we responsible for the privacy policy or practices of third party website linked to BRAVEPORT. We do not share any of the individual personal information you provide to BRAVEPORT with the websites to which BRAVEPORT links, although BRAVEPORT may share aggregate data with such website (such as how many people use our website). Our Privacy Policy only applies to information we collect from you while you are at and while you are actively in a session with BRAVEPORT. If you should link to a third party website from BRAVEPORT, we strongly encourage you to review and become familiar with that website’s privacy policy. Please keep in mind that whenever you voluntarily disclose personal information online – for example through e-mail, discussion lists, or elsewhere – that information can be collected and used by others. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. Ultimately, you are responsible for maintaining the secrecy of your personal information.
BRAVEPORT also maintains a strict “No-Spam” policy. We do not intend to sell, rent, or otherwise give your e-mail address to a third-party, without your consent. In addition, BRAVEPORT will not send you email that you have not agreed to receive. We may from time to time send e-mail announcing new BRAVEPORT products and services.
As an added benefit to the visitors of BRAVEPORT’s website, we send e-mail announcements to individuals who request to receive them. When you sign up for a BRAVEPORT e-mail newsletter, you are given the opportunity to also receive announcement lists from third parties. If you choose to receive a specific announcement list, you will receive commercial messages that are related to the topic of the list from independent third-parties that have contracted with BRAVEPORT to send messages. Contact us to be removed from the list. Personally identifiable information will not be used by BRAVEPORT for any purposes other than to deliver the newsletters. You may stop the arrival of these announcement lists at any time by removing your e-mail address from the list by forwarding the announcement list, or by following the instructions on the e-mails you receive.
VI. Instant Estimate Requests and the Life Settlement Calculator
If you submit a request for an instant estimate using our life settlement calculator tool, we will collect information from you to assist BRAVEPORT in the evaluation and qualification for a possible life/viatical settlement. The results of this instant estimate are not intended to represent a bid or offer to purchase a life insurance policy. Use of our life settlement calculator does not guarantee that any life/viatical settlement provider will purchase or offer to purchase a policy. By using the life settlement calculator, you authorize BRAVEPORT to collect, analyze, review and maintain your information in accordance with our Privacy Policy. Further, by using our life settlement calculator tool, you authorize BRAVEPORT to contact you by telephone and/or email.
The life settlement calculator tool is for informational purposes only and should not be relied upon by a policy owner or insured to determine whether to sell, hold, lapse or surrender a life insurance policy. BRAVEPORT shall not be liable, and you agree to hold BRAVEPORT harmless, from any action, inaction or decision made by you relating to your use of the information or results from the life settlement calculator.
VII. Changes to Our Privacy Policy
We reserve the right to change this Privacy Policy without providing you with advance notice of our intent to make the changes.
VIII. Withdrawal of Consent to Release Personal Information
You may withdraw your consent at any time (subject to legal or contractual obligations and on providing us with reasonable notice) by contacting our President at the address or telephone number below. Please be aware that withdrawing your consent may prevent us from providing you with the products and services offered by BRAVEPORT.
